Rangeley Lakefront Cabin #1 Guest Rental Agreement
Agent(s) & Renter:
In this agreement, Agent refers to Shaun Swain; Renter refers to the person submitting this Agreement.
The Rental Property consists of Rangeley Cabin #1, located at 5 Swains Road, Rangeley Plantation, County of Franklin, State of Maine.
A non-refundable deposit of 50% of rental fee must be paid upon signing this Agreement and is required to secure your reservation. The remaining 50% non-refundable balance is due 14 days from your "check-in" date. All payments shall be mailed or delivered to Agent Shaun Swain, 811 Thurston Hill Road, Madison ME 04950. You may pay by check or cash but a credit card number may be required,and will be held, but not charged unless needed as a security deposit or to repair/replace damaged items. See details under "Security Deposit".
By accepting the terms of this agreement you authorize Agent Shaun Swain to debit your credit card account to reimburse Agent(s) for costs incurred to repair/replace damaged items. Renter is responsible for any damage, abuse, excessive cleanup requirements, or loss caused by any member or Renter/Guest party to the property or its contents during occupancy, including damage due to freezing plumbing. Agent(s) will make that final determination of the necessity of any charges to Renter/Guests.
Renter deposit is non-refundable. In the event that Renter cancels reservation, please notify Agent(s) by phone and in writing as soon as possible. No money will be credited for late arrival or early departure. Balance is non-refundable.
Check-In / Check-Out:
Rangeley Lakefront Cabin #1 check in time is 3:00 p.m. Check out time is 10:00 a.m . One key will be inside the cabin door on the key rack. Please re-hang the key and leave doors unlocked upon your departure.
All bedding is provided; cotton sheets & pillowcases, a blanket and a quilt for each bed. Bedding will not be changed during the Rental Period. Laundry facilities are located nearby.
The Property is leased in "as is" condition. All Renter/Guests shall comply with the conditions and restrictions imposed upon Renter under this Agreement. Renter shall use the property in a manner so as to prevent any damage, injury, deterioration, or loss to the property; Renter shall prevent any soiling, staining, or damage to carpet, furnishings, floors, woodwork, and walls. Any damage, soiling or other injury to the property caused or allowed by Renter shall be promptly repaired, cleaned, and restored at Renter's expense. Pets are not allowed unless arraigned for in advance. Please contact Agent Shaun Swain as soon as possible upon discovering any items that need to be repaired. Certain outbuildings in the Rental Property are locked for the Agent(s) personal storage and are not included in this rental agreement.
You may swim and boat on Rangeley Cabin #1 Shoreline, and agree to indemnify and hold harmless Agent(s) and the Property Owner from and against any costs, damages, claims, liabilities, and other actions resulting from damage or destruction of property, or injury to persons, or loss of life caused by or resulting from any act or neglect of Renter or Renter's family, guests, or visitors.
Renter/Guests are required to leave the property in the same general condition it was in when they arrived. Renter/Guests shall be responsible for leaving dishes, pots, pans and all utensils clean. If additional cleaning, beyone what is expected after a stay, is required, appropriate charges will be made to Renters credit card. If, due to Renter/ Guests occupancy after check-out time, our cleaners are unable to enter the property and perform their job, a $40 per hour fee will be deducted from Renters credit card for the hours the property remains occupied.
Entry and Inspection:
Agent(s) reserves the right to enter the property at all reasonable hours, to investigate disturbances, check occupancy, check for damage, to make such repairs, alterations or improvements thereto as Agent(s) may deem appropriate, but the Agent(s) agrees not to exercise this right in such a way as to unreasonably interfere with the quiet enjoyment of the Renter/Guests.
Renter agrees that all personal property and personal effects brought into the property shall be at the sole risk of Renter with regard to any theft, damage, destruction, or other loss; Renter/Guests hereby covenants and agrees to indemnify and hold harmless Agent(s) from and against any costs, damages, claims, liabilities, and other actions resulting from damage or destruction of property, or injury to persons, or loss of life caused by or resulting from any act or neglect of Renter or Renter's family, guests, or visitors. Damages and expenses covered by this indemnification and hold harmless covenant shall include but not be limited to reasonable attorney's fees incurred by Agent(s) or the property owner in connection with any such matters. Renter assumes all risk related to use of the property by Renter and Renters family members, guests and visitors. Agent(s) is not responsible for compensation of any payments due to short-term inconveniences.
Tobacco, Alcohol, Illegal Drugs, Firearms & Law Enforcement:
Smoking is allowed on the grounds of the Rental Property, but not inside Rangeley Lakefront Cabin #1. There shall be no consumption of alcoholic beverages in or on the grounds of the Rental Property by any minor under twenty-one (21) years of age. There shall be no use of any illegal drugs by any Renter/Guests, occupants or visitors in or on the grounds of the Rental Property. Firearms shall not be loaded or discharged in Rangeley Lakefront Cabin #1. Any complaints to the Police Department concerning the behavior of the Renter/Guests or visitors while occupying the Rental Property shall, at the Agent(s) sole option, result in immediate discharge of Renter/Guests.
In the event of breach of this agreement by Renter/Guests, Agent(s) reserves all rights and remedies conferred under the laws of the State of Maine, including the right to terminate the lease, the right to immediate possession of the premises, and the right to all damages.
Unavailability of Property:
In the event Rangeley Lakefront Cabin #1 is not available for use during the term of this Agreement due to reasons, events, or circumstances beyond the control of Agent(s) including Acts of God, Agent(s) will attempt to locate a replacement property. If such replacement property cannot be located and made available to Renter, agent shall immediately return all payments made by Renter, whereupon this agreement shall be terminated, and Renter and Agent(s) will have no further obligations or liabilities in any manner pertaining to this agreement.
